Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Omnia Capital Partners USA LLC, operating the Annuity Score One brand ("Annuity Score One," "we," "us," or "our"). By accessing annuityscore.one, creating an account, running the Annuity Position Score™ assessment, or engaging our annuity review services (the "Services"), you agree to these Terms.
Please read Section 17 carefully. It contains a binding arbitration agreement and class action waiver that affects how you can bring disputes against us.
What Annuity Score One is — and is not
Annuity Score One is an educational annuity review service. We help annuity owners understand where the contract they already own stands across five independent pillars — Cost & Fees, Surrender Status, Riders & Guarantees, Rate & Crediting, and Suitability & Fit — and, when useful, introduce them to a licensed specialist.
We are not, and do not act as: an insurance carrier, a broker-dealer, a registered investment adviser, a municipal advisor, a tax adviser, or a law firm. We do not sell, issue, underwrite, or replace annuities and we do not custody client funds. Any annuity transaction — including a purchase, surrender, replacement, or IRC §1035 exchange — is executed by a licensed insurance professional at a state-authorized carrier, not by Annuity Score One.
We do not guarantee any specific crediting rate, income amount, tax result, or outcome. The Annuity Position Score is an educational tool, not a recommendation to buy, sell, surrender, or replace any annuity.
Eligibility
You must be at least 18 years old and legally able to enter contracts to use the Services. If you use the Services on behalf of an entity or another person, you represent that you have authority to bind that party.
Free tools and paid engagements
The Annuity Position Score assessment is provided free of charge, on an as-is basis, for educational purposes. Any paid engagement with a licensed specialist is governed by a separate engagement letter or agreement between you and that specialist.
How we are compensated
Annuity Score One earns a flat file, lead, or appointment fee. Our compensation is never contingent on whether you surrender, replace, or 1035 exchange an annuity, on any insurance commission, or on any other transaction outcome. Licensed specialists you speak with are compensated separately by their carriers or firms; those relationships and any commissions are disclosed to you in writing before any transaction.
Accounts and accuracy
You are responsible for keeping your login credentials confidential and for the accuracy of the information you submit. You agree not to submit false, misleading, or fraudulent information to us or to any licensed specialist we introduce.
Sage (AI tool)
Sage is an artificial-intelligence tool. Sage is not a licensed insurance, tax, or investment professional. Sage may contain inaccuracies, may misinterpret user input, and may cite information that is out of date. Do not rely on Sage as a substitute for advice from a licensed professional in your state.
Intellectual property
The Services — including the Annuity Position Score™, methodologies, reports, dashboards, templates, and all associated software and content — are owned by Omnia Capital Partners USA LLC or its licensors. The Annuity Position Score™ is proprietary technology of Apex Amplify, Inc., licensed exclusively to Omnia Capital Partners USA LLC. You may not copy, modify, distribute, reverse-engineer, or create derivative works from the Services except as expressly permitted.
Third-party services and introductions
The Services may link to or introduce you to third parties, including licensed insurance professionals, carriers, custodians, and information sources. We are not responsible for the acts, omissions, content, or products of any third party. Any engagement you enter with a third party is between you and that party.
Acceptable use
You agree not to:
- Provide false, misleading, or fraudulent information to us or to any licensed specialist we introduce.
- Use the Services to violate any law, regulation, or third-party right.
- Attempt to interfere with, disrupt, or gain unauthorized access to the Services.
- Scrape, harvest, or otherwise extract data from the Services except as expressly permitted.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
Communications consent (TCPA)
By submitting the assessment gate, the contact form, or any other request-for-contact surface, you consent to be contacted by Annuity Score One and, at your request, by an introduced licensed specialist about your inquiry, including by email, phone call, and SMS/text messages, at the numbers and addresses you provide, using automated technology where applicable. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY SCORE, OBSERVATION, OR OUTPUT WILL BE ACCURATE, TIMELY, OR SUITABLE FOR YOUR CIRCUMSTANCES. NO OUTCOME IS GUARANTEED.
Do not surrender or stop payments on any annuity based on this platform without first consulting a licensed professional in your state.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL ANNUITY SCORE ONE, OMNIA CAPITAL PARTNERS USA LLC, APEX AMPLIFY, INC., OR THEIR OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF (A) FEES YOU HAVE PAID TO US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY OR (B) ONE HUNDRED U.S. DOLLARS (USD $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO THESE MAY NOT APPLY TO YOU.
Indemnification
You will indemnify and hold harmless Annuity Score One, Omnia Capital Partners USA LLC, Apex Amplify, Inc., and their affiliates from and against any claim arising out of (a) your use of the Services, (b) any information you submit that is inaccurate or misleading, (c) any transaction you enter with a licensed specialist or carrier introduced through the Services, or (d) your violation of these Terms or any law.
Termination
We may suspend or terminate your access to the Services at any time for any lawful reason. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, indemnification, and dispute resolution.
Governing law
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws principles. Except as provided in Section 17, the courts located in Sheridan County, Wyoming have exclusive jurisdiction over any dispute not subject to arbitration.
Changes to these Terms
We may update these Terms from time to time. Material changes will be posted on this page with a new "Last updated" date and, where required, communicated to you. Your continued use of the Services after changes take effect constitutes acceptance.
Arbitration and class action waiver
Please read this section carefully. Except for claims for injunctive relief regarding intellectual property, any dispute arising out of or relating to these Terms or the Services will be resolved by final and binding arbitration administered by JAMS under its Streamlined Arbitration Rules, seated in Sheridan, Wyoming, before a single arbitrator. You and Annuity Score One each waive the right to a jury trial and the right to participate in a class, collective, or representative action. If the class-action waiver is held unenforceable, the entire arbitration provision will be void.
You may opt out of this arbitration provision by emailing info@omniacap.ai with the subject line "Arbitration Opt-Out" within thirty (30) days of first accepting these Terms.
